GENERAL INFORMATION & CONDITIONS OF USE

 

  1. General The general terms and conditions of the online store lyasangels.com are composed in accordance with the Consumer Protection Act (ZVPot), based on the recommendations of the Chamber of Commerce and Industry of Slovenia (GZS), and international codes for e-commerce.

The online store Lya's angels (hereinafter referred to as "lyasangels.com" or "online store") is operated by the company Darja Krecenbaher s.p. (hereinafter referred to as "company" or "provider").

The online store lyasangels.com and all data on it, images of products, graphic and video elements on the website are protected by the Copyright Law and may not be reproduced or used without prior written permission.

The lyasangels.com brand and logo are owned by the company Darja Krecenbaher s.p.

These General Terms and Conditions define the operation of lyasangels.com, the rights and obligations of visitors, users, and customers, and the business relationship between the provider and the user as a customer of products from the online store's offer.

Accessibility of Information The provider undertakes to ensure that the following information is always available to the user:

  • Information about the identity of the provider (in particular the company name and registered office, and the registration number where the company is registered); • Contact details enabling the user to communicate quickly and efficiently with the provider (email address, telephone number, etc.); • Information about the essential characteristics of the products or services from the online store's offer, including after-sales services and warranties; • Information about the availability of products or services from the online store's offer; • The method and conditions of delivery of products or execution of services, in particular the place and time of delivery; • Information about the method of payment; • Information about the time validity of the offer from the online store; • Information about the deadline for withdrawing from the contract and the conditions for withdrawal; • Information about the possibility of returning products and whether and how much such a return costs the user; • Information about the procedure for user complaints and contact details of the provider's contact person for communication with users.
  1. Payment Methods You can choose the payment method during the purchase process:
  • Cash on delivery is not possible.
  • Payment via PayPal system. 
  • Payment by credit cards.

For orders of products worth over 150.00 EUR, packaging and delivery costs are free.  Shipping within Slovenia is 5,00 EUR, shipping to EU countries is 10,00 EUR. 

Note: These terms and conditions, as well as packaging and delivery costs, apply only to Slovenia. For any deliveries to other countries, delivery costs are charged according to the courier company's price list. Also, the buyer bears any customs duties in countries outside Slovenia. In the event of frequent non-collection of dispatched packages, we reserve the right for the customer to pay for the package before dispatch (by pro forma invoice).

TAXES are not included in the price.

Prices Prices are valid at the time of placing the order and have no predetermined validity. All prices are expressed in EUR. All special offers on the website are valid until the specified date or until stock runs out. Promotions and special offers are mutually exclusive unless stated otherwise. The seller reserves the right to change prices without prior notice.

  1. Registration By registering in the online store, the visitor obtains a username, which is the same as his email address, and a password, which the user determines himself. The username and password clearly identify and link the user to the entered data. This facilitates the purchase process for the buyer, and the provider ensures that the data is fully protected and used in accordance with the terms agreed upon by the (potential) buyer. When ordering a product in the online store lyasangels.com, registration is not required.

The following information is required for a successful purchase: payer's address or delivery address, mobile phone number, and email address where the buyer receives the purchase confirmation. By successfully placing an order or making a purchase on the website, you agree to these general terms and conditions.

  1. Changes and Cancellation of Orders All desired changes regarding the submitted order can be communicated by replying to the email received upon order placement, by contacting us via

email at info@lyasangels.com.

The customer has the right to cancel the order up to 2 hours after the order is placed. After this period, cancellation of the order is no longer possible. In case of timely cancellation of the order, no costs are incurred for the customer. The customer can cancel the order later as well, but only if it is notified by email that the ordered product is temporarily out of stock. You can cancel the order by email at info@lyasangel.com. The seller has the right to cancel the order if, due to sold-out stocks, unavailability of goods, or other circumstances, it is unable to deliver the goods to the customer within the specified time frame in these terms and conditions or at the price listed on the website, if no alternative agreement is reached with the customer. The customer will be notified of the cancellation of the order by phone or email, and in the case of refunding the purchase price or part thereof, the financial funds will be returned within 14 days to the bank account specified in the order, unless otherwise agreed with the seller.

  1. Warranty for Technical Products The online store issues a minimum one-year warranty for purchased technical products, which is valid from the date of purchase. This warranty applies to all defects that can be proven to have been caused by defects in material and workmanship that existed at the time of delivery. In the online store www.lyasangels.com, we will replace products with new ones. Purchased products include an invoice and instructions for use. To claim the warranty, you must present the invoice. According to the law, the online store www.lyasangels.com must resolve the warranty within 45 days. Products approved under warranty become the property of the company Darja Krecenbaher s.p..

To claim the warranty, it is necessary to present the invoice. According to the law, the online store www.lyasangels.com must resolve the warranty within 45 days. Products approved under warranty become the property of the company Darja Krecenbaher s.p..
  3. Notification of Liability for Defects The seller (provider) must deliver the goods to the consumer (buyer) in accordance with the contract and is liable for material defects in their fulfillment. A defect is material:
  • if the item lacks the qualities necessary for its normal use or for circulation;
  • if the item does not have the characteristics necessary for a particular use for which the buyer is purchasing it, which were known to the seller or should have been known to them;
  • if the item does not have the characteristics and features that were expressly or tacitly agreed upon or prescribed;
  • if the seller has delivered an item that does not match the sample or model, unless the sample or model was shown only for notification.

The suitability of the goods for normal use is assessed based on the usual goods of the same kind and taking into account any seller statements about the characteristics of the goods, provided by the seller or manufacturer, particularly through advertising, product presentation, or statements on the goods themselves. The consumer may assert their rights due to a material defect if they notify the seller of the defect within two months from the day the defect was discovered. Subsequent complaints will not be considered. The consumer must describe the defect more precisely in the notice of defect and allow the seller to inspect the item. The consumer can notify the seller of the defect in person, for which the seller must issue a receipt, or send it to the store where the item was purchased, or to the seller's representative with whom they have contracted. The seller is not liable for material defects in the goods that appear after two years have passed since the item was delivered. It is considered that the defect in the item existed at the time of delivery if it appears within six months of delivery. A consumer who has properly notified the seller of the defect has the right to demand that the seller rectify the defect in the goods, return part of the paid amount in proportion to the defect, or replace the defective goods with new ones without defects, or return the paid amount. In any case, the consumer also has the right to demand compensation from the seller, particularly reimbursement of the cost of materials, replacement parts, labor, transfer, and transportation of products incurred due to fulfilling the obligations from the previous paragraph of this article. The consumer's rights from the first paragraph expire two years from the day they notified the seller of the material defect.

  1. Withdrawal from the Contract and Return of Goods In contracts concluded at a distance, the consumer has the right to notify the company via email at info@lyasangels.com within 14 days that they are withdrawing from the contract, without having to state a reason for their decision. The consumer's withdrawal statement is considered timely if sent within the period specified for withdrawing from the contract.

The consumer must return the goods to the company within 14 days of notifying the company of their withdrawal from the order.

The consumer returns the goods to the address: Darja Krecenbaher s.p., Ulica pri skali 12, 2360 Radlje ob Dravi, mail: info@lyasangels.com, Tel: +386 40802731. The purchased items must be returned to the company undamaged, unworn, unwashed, in the original packaging, with the label and in the original quantity, unless the items are destroyed, spoiled, lost, or their quantity has decreased without the consumer's fault. If the postal package with which the consumer received the ordered items is physically damaged, if the content is missing, or if there are signs of tampering, the consumer must initiate a complaint procedure with courier service. Upon receiving the goods, the company will refund all payments made by the consumer in accordance with the law. The only cost borne by the consumer in connection with the withdrawal from the order is the direct cost of returning the goods. Shipments with cash on delivery are not accepted and are rejected upon delivery. The refund of payments made will be made as soon as possible, no later than 14 days from the receipt of the returned goods, or until the consumer provides evidence that the goods have been sent back, unless the company offers the option to pick up the returned goods itself. For the sake of certainty, accuracy, and timeliness of the refund, and for maintaining a record of payments, the refund of payment to the consumer is made using the same payment method used by the consumer, unless the consumer explicitly requests the use of another payment method, and if the consumer does not incur any costs as a result.

10.1 THE CUSTOMER DOES NOT HAVE THE RIGHT TO WITHDRAW FROM THE CONTRACT AS SPECIFIED IN ARTICLE 43 OF THE ZVpot:

Unless otherwise agreed by the contracting parties, the consumer does not have the right to withdraw from the contract from the first paragraph of this article in the following contracts:

  • for goods or services, the price of which depends on fluctuations in the market that the company cannot influence and which may occur within the withdrawal period;
  • for goods made according to the consumer's exact instructions and customized to their personal needs;
  • for goods that are perishable or expire quickly;
  • for services if the company has fully performed the contract and the performance of the service began with the consumer's explicit prior consent and agreement to waive the right to withdraw once the company has fully performed the contract;
  • for the delivery of sealed audio or video recordings and computer software if the consumer has unsealed the security seal after delivery;
  • for the delivery of newspapers, periodicals, or magazines except for subscription contracts for the supply of such publications;
  • for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons if the consumer has unsealed them after delivery;
  • for the delivery of goods which, by their nature, are inseparably mixed with other items;
  • concluded at public auctions;
  • for accommodation services not intended for permanent residence, the transport of goods, the rental of vehicles, the preparation and delivery of food, or services related to leisure activities where the company undertakes to provide these services on a specific date or within a specified period;
  • for the supply of digital content that is not supplied on a tangible medium if the performance has begun with the consumer's explicit prior consent and acknowledgment that they thereby lose their right to withdraw from the contract.

WARNING: According to item 7 of Article 43 of the ZVPot, returns of swimwear will be refused if the protective film on the bottom part of the swimwear is removed or if there are visible signs of testing (secretion or any other stain). Swimwear must be tried on over underwear together with the protective film to ensure appropriate hygiene standards. If there are any signs of testing on the swimwear, the return will be refused. We do not accept later complaints.

11.Returning Products with Quantity Discounts

In the event of withdrawal from the contract for products with quantity discounts, the customer who wants to receive the full refund amount must return all the products. If the customer does not return all the products, they may keep them only at the full price (without the quantity discount) available in the online store, or in the case of tiered discounts, the appropriate tier amount for the retained products will be applied. In the event of exercising the warranty, the customer has the right to replace individual items or the entire order received within the quantity discounts.

  1. 1 Free Exchange

We offer a free exchange of items that do not fit. The exchange process is as follows: place a new order for the new item and write EXCHANGE and the name of the item you wish to exchange in the notes section. If the new item is more expensive, the price difference is paid; if the item is cheaper, the price difference can be used as a credit for the next purchase or refunded to your bank account. Writing in the notes section is a condition for a successful exchange, as the exchange will not be considered without this note. Exchanges are conducted so that the delivery person brings the new package, and you simultaneously hand over your package with the items you wish to exchange, thus redirection of exchange packages to other usual collection points is not possible. In the case of exchanges within the first 5 days (28.05.2024 – 03.06.2024), the return costs are borne by the customer. The package must be adequately protected in the original packaging with all its components. We do not accept inadequately protected shipments. When exchanging swimwear, they must be in their original packaging, which must not be damaged or destroyed in any way. When exchanging swimwear or underwear, they must be clean, unworn, unwashed, with all components and undamaged. We advise you to try on underwear and swimwear over clothes or underwear. The exchange period is 14 days from the receipt of the goods. Free exchange is only possible once. The costs of re-exchange for already exchanged items are borne by the customer.

  1. Complaints and Disputes

The provider respects the applicable consumer protection legislation. The provider makes every effort to fulfill its duty to establish an effective complaint handling system and designate a person who can be contacted by the customer in case of problems via telephone or email. In case of issues, the customer can seek assistance at the info@lyasangels.com Complaints can be submitted via the email address info@lyasangels.com. The complaint handling process is confidential. The provider will confirm within 5 working days that it has received the complaint, inform the customer how long it will take to process it, and keep them informed about the progress of the procedure. The provider and the customer, as participants in electronic commerce, mutually acknowledge the validity of electronic messages in court.

  1. Out-of-Court Consumer Dispute Resolution

In accordance with legal norms, we do not recognize any provider of out-of-court consumer dispute resolution as competent for resolving consumer disputes that the consumer could initiate in accordance with the Act on Out-of-Court Settlement of Consumer Disputes. The company, which as a provider of goods and services enables online shopping in Slovenia, publishes an electronic link to the platform for online consumer dispute resolution (SRPS) on its website. This regulation arises from the Act on Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes, and amendments to Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.
